Intellectual property

Website content

All content on our sites — including text, photography, graphics, product imagery, logos, trade marks, and design — is the property of Jonite or its licensors and is protected by copyright, trade mark, and other intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any content from our sites without our prior written consent.

Product designs

All Jonite product designs, moulds, patterns, and configurations constitute our proprietary intellectual property and may be protected by registered and unregistered design rights, patents, copyright, and trade secrets. The purchase of any Jonite product does not confer any licence to reproduce, replicate, reverse-engineer, or manufacture any Jonite design, in whole or in part. Jonite reserves the right to seek injunctive relief and damages for any unauthorised reproduction or infringement of its designs.

Wall Visualiser & digital tools

Our sites include digital tools such as the Wall Visualiser, which allow you to preview products in a simulated environment. These tools are provided for illustrative guidance only. Visual representations — including colours, textures, and proportions — are approximations and may differ from the finished product. Outputs generated by our digital tools do not constitute professional specifications, design advice, or a guarantee of product appearance.

Jonite makes no warranty that outputs generated by our digital tools are accurate, complete, or suitable for inclusion in project specifications without independent verification. Jonite accepts no liability for any loss arising from reliance on such outputs.

Sample requests

Sample kits are available to professional specifiers including architects, landscape designers, and developers. Samples are provided as a general indication of product finish and texture only. Due to the natural variation inherent in stone composite materials, samples do not constitute an exact match guarantee for production batches, nor do they form part of any contractual description of goods.

Jonite reserves the right to limit sample requests and to decline requests at our discretion.

Third-party links

Our sites may contain links to third-party websites. These links are provided for your convenience only. Jonite has no control over the content or availability of those sites and accepts no responsibility or liability for them, or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply endorsement by Jonite.

Accuracy of information

We make every reasonable effort to ensure that the information on our sites is accurate and up to date. However, we make no representations or warranties, express or implied, as to the accuracy, completeness, or fitness for purpose of any information on our sites.

Product specifications, dimensions, and availability are subject to change without notice. Always confirm current specifications directly with Jonite before including products in a project specification.

Our sites are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Jonite excludes all implied warranties, conditions, and representations relating to our sites and their content.

Changes to these terms

We may update these Terms & Conditions at any time. Changes will be posted on this page with a revised date. Your continued use of our sites following any update constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

Products

The following terms apply to all purchases made through the Jonite online shop at shop.jonite.com. By completing a purchase, you confirm that you are 18 years of age or older, have the legal capacity to contract, and agree to all terms on this page.

Made-to-order nature

All Jonite products are manufactured to order using our engineered stone composite. Because production commences upon order confirmation, we are unable to accept cancellations once an order has been confirmed, subject to your statutory rights as set out in the Cancellations section below. Please review your order carefully before completing your purchase.

Standard and custom products

Our product range includes both standard catalogue products and bespoke or custom-configured products (including products ordered in custom dimensions, finishes, or configurations specified by you). Different cancellation rights may apply depending on the nature of your order, as set out below.

Product descriptions

We make every effort to ensure that product descriptions, dimensions, finishes, and imagery are accurate. However:

  • Colours and textures may vary slightly from screen representations due to monitor calibration and the natural variation inherent in stone composite materials.
  • Product specifications are subject to change without notice. The specification confirmed in your order confirmation shall govern.

Ordering & contract formation

Your order constitutes an offer to purchase. A binding contract between you and Jonite is formed only upon Jonite issuing a formal written order confirmation by email. We reserve the right to decline any order at our discretion, including where a product is unavailable, where we are unable to ship to your location, or where a pricing error has occurred.

Please ensure your order details, delivery address, and contact information are correct before submitting. We cannot be held responsible for delays or non-delivery arising from inaccurate information provided by you.

If you have not received an order confirmation within 48 hours of placing your order, please contact us at orders@jonite.com before assuming your order has been accepted.

Pricing & payment

Prices and taxes

All prices displayed on shop.jonite.com are in the currency shown at checkout. Prices are exclusive of Goods and Services Tax (GST) for Singapore-based customers, which will be added at the applicable rate at checkout. Prices are also exclusive of shipping charges, import duties, and any other applicable taxes for international orders, unless otherwise stated. The total amount payable, including all applicable charges, will be displayed before you confirm your order.

Pricing errors

Whilst we take care to ensure all prices on our site are accurate, errors may occasionally occur. If we discover a pricing error in respect of an order you have placed, we will notify you as soon as reasonably possible. You will have the option to reconfirm your order at the correct price or cancel it for a full refund. If we are unable to reach you using the contact details provided, the order will be treated as cancelled and any payment received will be refunded in full. Jonite is under no obligation to fulfil an order placed at an incorrect price.

Payment

Payment is required in full at the time of ordering. We accept major credit and debit cards processed via our third-party payment processor. Payment card data is handled exclusively by our payment processor and is not stored by Jonite. In the event of a failed or declined payment, your order will not be confirmed.

International orders

For international orders, you may be subject to import duties, customs clearance fees, and local taxes imposed by your country of destination. These charges are solely your responsibility as the importer of record and are not included in the product price or shipping charge displayed at checkout. Jonite has no control over and accepts no liability for such charges.

Cancellations

General

As all Jonite products are manufactured to order, production commences upon order confirmation. Accordingly, we do not accept cancellations once an order has been confirmed, except as set out below or as required by applicable law.

Consumer right of withdrawal (UK and EU consumers)

If you are a consumer resident in the United Kingdom or a member state of the European Union, you may have a statutory right of withdrawal under the Consumer Contracts Regulations 2013 (UK) and EU Directive 2011/83/EU respectively. This right of withdrawal does not apply to:

  • Goods made to your specifications or clearly personalised (including bespoke or custom-configured Jonite products ordered in dimensions, finishes, or configurations specified by you); or
  • Goods that have entered production and cannot reasonably be cancelled without material cost to Jonite.

Where you have ordered a standard catalogue product and production has not yet commenced, we will consider cancellation requests made within 24 hours of order confirmation. Please contact orders@jonite.com immediately if you wish to cancel. We cannot guarantee cancellation will be possible in all cases.

Exceptional circumstances

Outside of the above, cancellation requests may be considered at Jonite's sole discretion and may be subject to a cancellation charge reflecting the cost of materials and production already incurred.

Statutory rights preserved

Nothing in this clause affects your statutory rights as a consumer in relation to goods that are faulty, not as described, or not in conformity with the contract.

Lead times & delivery

Production lead times

Estimated production lead times will be communicated at the time of ordering and confirmed in your order confirmation. Lead times are estimates only and do not form part of the contract. Jonite will not be liable for delays caused by circumstances beyond our reasonable control, including Force Majeure Events as defined below.

Shipping

Shipping charges are calculated at checkout based on destination, weight, and dimensions of your order. For orders that exceed standard courier thresholds, a manual freight quote will be required. In such cases, you will be notified within 24 hours of placing your order, and your order will not proceed to production until you have confirmed acceptance of the applicable freight charge in writing.

Risk and title

Risk of loss or damage to the goods passes to you upon delivery to the address specified in your order. Title to the goods vests in you only upon receipt by Jonite of payment in full.

International shipments

For international orders, delivery is on a Delivered At Place (DAP) basis in accordance with Incoterms® 2020, unless otherwise agreed in writing. Import duties, taxes, and customs clearance fees are payable by you as the importer of record. Jonite accepts no liability for delays arising from customs processing or regulatory requirements in the destination country.

Partial delivery and non-delivery

Where delivery of part of an order is not possible, Jonite will notify you and arrange for delivery of the available goods. Partial delivery does not entitle you to cancel the remainder of the order unless agreed in writing. If delivery is impossible due to circumstances attributable to you (including an incorrect delivery address or failure to accept delivery), any re-delivery costs will be borne by you.

Freight damage & delivery issues

You must inspect your delivery promptly upon receipt. If goods arrive visibly damaged, you must:

  • Note the damage on the carrier's delivery documentation before signing for the consignment.
  • Photograph the damaged outer packaging and the goods themselves immediately upon discovery.
  • Notify Jonite in writing at orders@jonite.com within 48 hours of delivery, including your order number, photographs, and a description of the damage.

Claims for freight damage notified after 48 hours of delivery may not be accepted, as carriers impose strict notification windows on consignees. Jonite will work with you and the carrier to resolve valid claims, which may include replacement of the damaged goods. Jonite's liability in respect of freight damage is limited to the replacement value of the damaged goods and does not extend to consequential or economic losses.

Returns & refunds

As all products are manufactured to order, we do not accept returns or provide refunds except in the following circumstances:

  • The goods delivered are not in conformity with the contract (including where they do not match the confirmed order specification or are of unsatisfactory quality); or
  • The goods are affected by an inherent defect or manufacturing defect present at the time of delivery.

To initiate a return or refund claim, please contact orders@jonite.com within 14 days of delivery, providing your order number, a written description of the non-conformity or defect, and supporting photographic evidence. We will assess your claim and respond within 5 business days.

Where a valid claim is established, Jonite will, at its election, either replace the non-conforming or defective goods or issue a refund to your original payment method. Refunds will be processed within 10 business days of the claim being approved.

Statutory rights preserved

Nothing in this clause limits or excludes any statutory rights you may have as a consumer. If you are a consumer in the United Kingdom, your rights under the Consumer Rights Act 2015 apply in addition to and are not affected by these terms, including your right to a repair, replacement, or refund in respect of goods that do not conform to contract.

Force majeure

Jonite shall not be in breach of these terms, nor liable for any delay or failure in performance, to the extent that such delay or failure results from a Force Majeure Event. A "Force Majeure Event" means any event or circumstance beyond Jonite's reasonable control, including but not limited to: acts of God, natural disasters, pandemic or epidemic, war, terrorism, civil unrest, government action or regulation, strikes or industrial action, interruption or failure of utility services, or disruption to supply chains or transport networks.

Where a Force Majeure Event occurs, Jonite will notify you as soon as reasonably practicable and will use reasonable endeavours to resume performance. If a Force Majeure Event continues for more than 60 days, either party may terminate the affected order by written notice, and Jonite will refund any amounts paid for goods not yet delivered.

Limitation of liability

Cap on liability

To the fullest extent permitted by applicable law, Jonite's total aggregate liability to you in connection with any order, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you for that order.

Exclusion of indirect loss

Jonite shall not be liable for any indirect, special, incidental, or consequential loss or damage, or for any loss of profit, loss of revenue, loss of business, loss of anticipated savings, or loss of data, arising out of or in connection with any order or these terms, even if Jonite has been advised of the possibility of such loss.

Losses not excluded

Nothing in these terms limits or excludes Jonite's liability for:

  • Death or personal injury caused by Jonite's negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability that cannot lawfully be excluded or limited, including liability under the Consumer Rights Act 2015 and the Consumer Protection Act 1987 where applicable to UK consumers; or
  • Any other liability that cannot be excluded or limited under applicable law.

Governing law & dispute resolution

These Terms & Conditions are governed by and construed in accordance with the laws of Singapore. Subject to the consumer protection provision below, any dispute arising out of or in connection with these terms shall be subject to the non-exclusive jurisdiction of the courts of Singapore.

We will always endeavour to resolve disputes amicably in the first instance. If you have a complaint, please contact us at orders@jonite.com and we will use reasonable endeavours to resolve the matter promptly.

Consumer protection

If you are a consumer habitually resident in the United Kingdom or a member state of the European Union, you retain the right to bring proceedings in the courts of your country of habitual residence and to invoke the mandatory consumer protection laws of that country. Such mandatory provisions shall apply in your favour to the extent that they afford you greater protection than Singapore law.

General provisions

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

Entire agreement

These terms, together with our Privacy Policy and any order confirmation issued by Jonite, constitute the entire agreement between you and Jonite in relation to your use of our sites and any purchase made through them. They supersede all prior representations, agreements, or understandings, whether written or oral.

Waiver

No failure or delay by Jonite in exercising any right or remedy under these terms shall constitute a waiver of that right or remedy. A waiver of any breach shall not be construed as a waiver of any subsequent breach.

Assignment

Jonite may assign, transfer, or subcontract its rights and obligations under these terms to any group company or successor entity without your consent. You may not assign or transfer your rights or obligations under these terms without Jonite's prior written consent.

Notices

Any formal notice required under these terms shall be in writing and delivered by email to the addresses set out below. Notices sent by email shall be deemed received on the next business day following transmission, provided no delivery failure notification is received.
